Gifts Received by MLAs

Section 13 of the Act permits a Member or a person belonging to a Member’s family to receive a fee, gift or personal benefit connected directly or indirectly with the performance of the Member’s duties of office in only the following circumstances:

(i) the gift is accepted as a matter of protocol, custom or social obligation that normally accompanies their responsibilities or;

(ii) the gift is of such a nature it could not reasonably be regarded as likely to influence the Member in the performance of his or her duties.

If a gift is received in either of these circumstances and the value of the gift exceeds $500, or if the total value of gifts received from one source in any 12 month period exceeds $500 in value, they must be disclosed to the Commissioner, who must then include them in the Member’s public disclosure statement.
